1. Agreement to Terms

By downloading, installing, or using StealthOS ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application. These Terms constitute a legally binding agreement between you and Olib AI ("we," "our," or "us").

2. Description of Service

StealthOS is a privacy-focused application for iOS that provides:

A privacy-enhanced web browser with anti-fingerprinting and AI-powered security features
Encrypted local file storage using AES-256-GCM encryption
Password manager with TOTP 2FA support and browser autofill
On-device AI assistant powered by Apple Intelligence (iOS 26+)
Local peer-to-peer communication (Connection Pool, Pool Chat) with end-to-end encryption
Developer tools (SSH terminal, Linux shell, code editor, network inspector)
Productivity tools (notes with voice transcription, calculator)
Built-in games with local multiplayer support
Optional network privacy features (VPN, Tor, proxy, custom DNS)

The Application is provided as a tool for legitimate privacy protection purposes. Core features operate entirely on-device without external API connections. Local communication features use peer-to-peer connections via WiFi or Bluetooth and do not require internet access.

3. Acceptable Use Policy

You agree to use StealthOS only for lawful purposes and in accordance with all applicable laws and regulations.

3.1 Prohibited Activities

You agree NOT to use the Application to:

Violate any applicable local, state, national, or international law or regulation
Engage in any illegal activities, including but not limited to fraud, hacking, or unauthorized access to systems
Access, download, or distribute child sexual abuse material (CSAM) or any illegal content
Harass, threaten, defame, or harm others
Infringe upon intellectual property rights of others
Distribute malware, viruses, or other harmful code
Engage in identity theft or impersonation
Circumvent security measures of other systems or networks without authorization
Facilitate or participate in terrorism or violent extremism
Engage in money laundering or financial crimes
Violate export control laws or sanctions

3.2 Your Responsibility

You are solely responsible for your use of the Application and any consequences thereof. The privacy features provided are intended to protect legitimate privacy interests and must not be used to facilitate illegal activities.

4. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOU USE THIS APPLICATION ENTIRELY AT YOUR OWN RISK.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Any warranty that the Application will be uninterrupted, secure, or error-free
Any warranty regarding the accuracy, reliability, or completeness of any content
Any warranty that defects will be corrected
Any warranty that the Application will meet your specific requirements
Any warranty that security features will prevent all attacks, breaches, or unauthorized access
Any warranty that encryption will be unbreakable or that your data will remain confidential

4.1 No Security Guarantee

WE DO NOT GUARANTEE THE SECURITY OF THE APPLICATION, YOUR DATA, OR ANY INFORMATION PROCESSED THROUGH THE APPLICATION. NO SYSTEM IS 100% SECURE.

You expressly acknowledge and agree that:

No encryption, security measure, or privacy feature is guaranteed to be impenetrable or foolproof
We do not guarantee protection against hackers, malware, data breaches, or security vulnerabilities
Anti-fingerprinting and privacy features may not protect against all tracking technologies, especially advanced or future methods
Phishing detection, malware scanning, and security features may not detect all threats
End-to-end encryption in Pool Chat does not guarantee absolute security of your communications
Password Manager security depends on the strength of your master password and device security
We cannot guarantee that third parties will not find ways to access, intercept, or compromise your data
Security vulnerabilities may exist in the Application, Apple's frameworks, or third-party components

You are solely responsible for: maintaining the security of your device, choosing strong passwords, keeping your software updated, and taking appropriate precautions to protect your data. You assume all risk associated with the use of the Application's security and privacy features.

4.2 Assumption of Risk

BY USING STEALTHOS, YOU EXPRESSLY ASSUME ALL RISKS associated with:

Loss, theft, corruption, or unauthorized access to your encrypted files and data
Compromise of your passwords, credentials, or TOTP secrets stored in Password Manager
Interception or exposure of your browsing activity despite privacy features
Security breaches affecting local peer-to-peer communications
Failure of security features to detect phishing, malware, or other threats
Data loss due to encryption key loss, app deletion, or device issues
Any consequences resulting from connecting to SSH servers, VPNs, Tor, or other network services
Legal consequences of your online activities while using the Application

You agree that Olib AI shall not be liable for any damages, losses, or harm resulting from any of the above risks, regardless of whether we were advised of the possibility of such damages.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OLIB AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, use, goodwill, or other intangible losses
Any damages resulting from unauthorized access to or alteration of your data
Any damages resulting from security breaches, hacking, or data theft
Any damages resulting from failure of encryption, privacy, or security features
Any damages resulting from loss of passwords, credentials, or encrypted data
Any damages resulting from your use or inability to use the Application
Any damages resulting from any third-party content or services accessed through the Application
Any damages resulting from your violation of these Terms or applicable laws
Any legal consequences arising from your misuse of the Application
Any damages arising from reliance on the Application's security or privacy features

This limitation applies regardless of the legal theory under which damages are sought, whether in contract, tort (including negligence), strict liability, or otherwise.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS LESS.

6. Indemnification

You agree to indemnify, defend, and hold harmless Olib AI and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

Your use or misuse of the Application
Your violation of these Terms
Your violation of any applicable laws or regulations
Your violation of any rights of a third party
Any content you create, transmit, or store using the Application

7. Intellectual Property

The Application, including its original content, features, and functionality, is owned by Olib AI and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Application without our prior written consent.

8. Third-Party Services and Content

The Application may allow you to access third-party websites, services, or content. We are not responsible for:

The content, accuracy, or opinions expressed on third-party websites
The privacy practices or terms of service of third-party websites
Any transactions you conduct with third parties
Any damages or losses caused by third-party services, including VPN providers and the Tor network
Remote servers you connect to via SSH terminal
Content or actions of peers in local Connection Pool networks

9. Premium Subscription

Certain features of StealthOS require a Premium subscription. By purchasing a subscription, you agree that:

Subscriptions are billed through Apple's App Store and governed by Apple's terms
Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
Refunds are handled by Apple according to their refund policies
We reserve the right to change subscription pricing with reasonable notice
Premium features may be modified, added, or removed at our discretion

10. Network Inspector (NetMap) Usage

The NetMap feature allows you to inspect network traffic within StealthOS. You agree to:

Only inspect traffic that you are authorized to analyze
Not use NetMap to intercept, capture, or analyze traffic from networks or systems you do not own or have explicit permission to test
Comply with all applicable laws regarding network monitoring and interception
Not use NetMap to bypass security measures or gain unauthorized access

NetMap only captures traffic within the StealthOS browser environment and does not affect other apps on your device.

11. Local Communication Features

Connection Pool and Pool Chat enable peer-to-peer communication between nearby devices. You acknowledge that:

All communication is end-to-end encrypted using Curve25519 and AES-256-GCM
We have no access to or visibility into your local communications
You are solely responsible for the content you share with peers
You must comply with all applicable laws regarding electronic communications
We are not responsible for the actions or content of other users in your pool
Local communication features should not be used for any illegal purposes

12. Age Requirements

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use StealthOS. If you are under 18, you represent that you have your parent's or guardian's permission to use the Application. We reserve the right to terminate accounts of users who do not meet these age requirements.

13. Termination

We reserve the right to terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Illegal or fraudulent activity
Conduct that we determine, in our sole discretion, is harmful to other users or third parties

Upon termination, your right to use the Application will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Application shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Compliance with Laws

You are responsible for complying with all applicable laws in your jurisdiction. The Application may not be available or appropriate for use in all locations.

We cooperate with law enforcement authorities when required by law. While we do not collect user data through the Application, we will comply with valid legal requests to the extent we have any relevant information.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Application after any changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Olib AI regarding the use of the Application and supersede all prior agreements and understandings.
